APPEAL TO THE SECRETARY OF HEALTH DR. ENRIQUE T. ONA FOR THE FULL IMPLEMENTATION OF THE MAGNA CARTA BENEFITS FOR HEALTHWORKERS OR R.A. 7305

 

In behalf of the health workers in the government service, we would like to bring to your kind attention our sentiments, namely :

 

1.         The passage of R.A. No. 7305 or the  Magna Carta of Public Health Workers in 1992 was a positive development for the health sector since it preserves the distinction of  health workers among other categories of government employees and linking the improvement in the well-being of the workers with enhancement of delivery of   health services.

2.         Since the enactment of the said law, there were several issuances by the department with regards to the payment of some of the Magna Carta Benefits which were being  enjoyed by all health  workers in the national government and some of  local government units until both Houses of Congress passed the  General Appropriations Act (GAA) of 2012.

3.         Section 41 of the GAA states that payment of Magna Carta benefits of  public health workers in the government shall be limited to the  appropriations authorized for the purpose. Augmentation thereof shall be taken from any available savings of the agency subject to the approval of the DBM.

4.         Accordingly, your office issued Department Memorandum No. 2012-0181 stopping the immediate payment of augmentation of hazard pay, laundry and subsistence allowance until the DBM Approves the use of sourced savings.

5.         While we do not begrudge your action to stop payment of the augmentation of said benefits in compliance with the GAA, nonetheless, it has caused financial crisis and instability among  the ranks and  their   families which led to their low morale and demoralization affecting the delivery of quality health services to the people.

 

In view of the said developments, the officers and members of the association earnestly appeal to the good secretary to undertake the following:

 

1.         To stand up for the welfare of the health workers being the father of the family. They are the  Most Valuable Asset in the organization.

2.         To prepare the budget for the FULL IMPLEMENTATION of the Magna Carta benefits in accordance with the said Act and its IRR and disregard parts of National Budget Circular No. 112 dated 29 December 2011related to magna carta budget being illegal and unconscionable.

3.         To lobby the DBM for the inclusion of the prepared Magna Carta budget AS LINE ITEM IN THE GAA effective 2014 and onwards in keeping with the legal mandate which is long overdue. It is noteworthy of mention that the DBM had already  issued a Circular to the Local Chief Executives directing the latter to include in their annual budget the provision of the magna carta benefits for their health workers.

4.         To bring to your attention the provisions of Section  37 of said Act regarding the Prohibition Against Elimination and /or Diminutionand we quote : ‘‘Nothing in this   law shall be construed to eliminate or in any way diminish benefits being enjoyed by Public Health Workers at the time of the effectivity of the Act.’’

 

In fine, give what is rightfully an legally due to the health workers in the interest of the service.

APPEAL TO THE SECRETARY OF HEALTH FOR THE FULL IMPLEMENTATION OF THE MAGNA CARTA BENEFITS OF PUBLIC HEALTH WORKERS

BOD RESOLUTION NO. 15 S. 2012

Whereas,  the PPHA was organized by the health workers in 1932 and duly registered before the Securities and Exchange Commission (SEC) with membership coming from the retained and devolved health workers including the BHWs in the country ;

 

Whereas, the declared  policy of the PPHA is to promote the welfare of all its members regardless of gender, creed, religion, or appointment, status of employment, socio-economic class and geographical location ;

 

Whereas, the passage of the Magna Carta of Public Health Workers or R.A. 7305 was a positive development for the health sector since it preserves the distinction of health workers

among other categories of government employees and linking the improvement in health workers’ well being with enhancement in delivery of health services ;

 

Whereas, the Secretary of Health was vested with the authority to formulate and prepare the necessary rules and regulations to implement the provisions of this Act in consultation with appropriate agencies of the Government as well as professional and health workers organizations or unions in accordance with Section 35 thereof until the passage of Joint Resolution No. 4 approved by the Congress of the Philippines on June 17, 2009;

 

Whereas, since the passage of the said Act in 1992, there were several issuances by the department with respect to the payment of the benefits which were being enjoyed by all health workers including some of the LGUs ;

 

Whereas, the Secretary of Health is mandated to submit annually the necessary budgetary estimates to implement the provisions of  this Act in staggered basis of implementation of the proposed benefits within a period of five (5) years. Budgetary estimates for the succeeding years should be reviewed and increased accordingly by the Health Secretary in consultation with the Department of Budget and Management (DBM) and the Congressional Commission on Health (HEALTHCOM) pursuant to Section 38 thereof ;

 

Whereas, DOH annually submits the budgetary estimates in line with the rates prescribed under the National Budget Management (NBM) Circulars to include payment of subsistence allowance in the amount of P30.00/day and laundry allowance of P130.00/month without budget provision for hazard pay and longevity pay which are all  inconsistent with what is mandated in said Act.  Thus, the payment of  the magna carta benefits are augmented from any available savings of the respective offices and subject to the approval by the DBM.

 

NOW, THEREFORE, it is resolved by the board of directors to make an Appeal to the Honorable Secretary of Health, Dr. Enrique T. Ona, namely :

 

1. To stand up for the welfare of the health workers as the father of the family. The health workers are the most valuable asset  in the organization  who shall carry out the mission and vision statements of the department with the highest degree of excellence and accountability.

 

2. To prepare the budget for all the magna carta benefits in accordance with the requirements set forth under the Magna Carta of Public Health Workers or R.A. 7305 and disregard the said NBM circulars being illegal and unconscionable.

 

3. To lobby the DBM for the inclusion of the prepared Magna Carta budget as line item in the GAA in keeping with the legal mandate which is long overdue. It is noteworthy of mention that the DBM had already issued a Circular to the Local Chief Executives directing the latter to include in their annual budget the provision of the magna carta benefits for their health workers.

 

4.To bring to your attention the provisions of Section  37 regarding the Prohibition Against Elimination and /or Diminution and we quote : ‘‘Nothing in this law shall be construed to eliminate or in any way diminish benefits being enjoyed by Public Health Workers at the time of the effectivity of the Act.’’ And the Joint House Resolution No. 4 specifically under item 6, sub.par. b which provides : ‘‘Nothing in the Joint Resolution shall be interpreted to reduce, diminish or, in any way, alter the benefits provided for in existing laws on Magna Carta benefits for specific officials and employees in government, regardless of whether said benefits have been already received or have yet to be implemented.’’

 

In fine, we appeal to your act of kindness and understanding. Give what is rightfully and legally due to the health workers in the interest of the service.
