URGENT MANIFEST TO DOH SECRETARY ENRIQUE T. ONA

WE, OFFICERS AND MEMBERS OF THE PHILIPPINE PUBLIC HEALTH ASSOCIATION, INC. STRONGLY VOICED OUT OUR OPPOSITION AND DISPLEASURE TO THE RECENTLY PASSED JOINT DBM-DOH CIRCULAR NO. 1 S. 2012 RE: MAGNA CARTA BENEFITS TO PUBLIC HEALTH WORKERS, THE SAME BEING UNCONSCIONABLE AND VIOLATIVE OF THE LAW.

UNDER JOINT RESOLUTION NO. 4 S. 2009 PASSED BY THE JOINT HOUSES OF CONGRESS ON JUNE 17, 2009 THE DEPARTMENT OF BUDGET AND MANAGEMENT (DBM), IN COORDINATION WITH THE AGENCIES CONCERNED, WAS GIVEN THE AUTHORITY TO DETERMINE THE QUALIFICATIONS, CONDITIONS, AND RATES IN THE GRANT OF SAID BENEFITS, TO THE EXCLUSION OF CONSULTATIVE COUNCILS, DEPARTMENTS, AND OFFICIALS PREVIOUSLY AUTHORIZED TO ISSUE THE IMPLEMENTING RULES AND REGULATIONS OF MAGNA CARTA BENEFITS.

HOWEVER, SAID RESOLUTION DIRECTED DBM TO ISSUE THE NECESSARY GUIDELINES, RULES AND REGULATIONS IN THE GRANT OF MAGNA CARTA BENEFITS WITHIN THE NINETY (90) DAY FROM ITS EFFECTIVITY BUT DBM FAILED TO COMPLY WITH THE SAME WITHIN THE PRESCRIBED PERIOD.

LIKEWISE, THE SAID JOINT CIRCULAR IS ALSO IN DIRECT CONTRAVENTION OF SECTION 37 OF RA 7305 AND ITEM 6, SUB PAR. B OF THE JOINT RESOLUTION NO. 4 WHICH BOTH PROHIBITS ALTERATION OR DIMINUTION OF BENEFITS ALREADY RECEIVED OR HAVE YET TO BE IMPLEMENTED.

AS A GOOD FATHER OF THE HEALTH SECTOR, WE URGE YOU TO RECALL THE SAID JOINT DBM-DOH CIRCULAR NO. 1 AND FULLY IMPLEMENT THE PROVISIONS OF THE MAGNA CARTA FOR PUBLIC HEALTH WORKERS OR RA 7305 WHICH WAS APPROVED ON MARCH 26, 1992.

WE LAMENT THAT SINCE THE PASSAGE OF THE MAGNA CARTA ACT 20 YEARS AGO, THE BENEFITS SAVE FOR SUBSISTENCE AND LAUNDRY ALLOWANCE (SLA) HAVE YET TO BE INCORPORATED IN THE GENERAL APPROPRIATIONS ACT (GAA).  THUS, GRANT OF SAID BENEFITS IS STILL SUBJECT TO SAVINGS UP TO THE PRESENT.

THUS, WE APPEAL TO YOUR SOUND JUDGMENT AND KIND HEART TO GRANT THESE BENEFITS IMMEDIATELY IN ACCORDANCE WITH LAW.
